  • Medicare Fee For Service Emergency & Disaster Related Policies and Procedures that may be implemented only with an 1135 Waiver (updated Oct 2011)
  • Note: An 1135 waiver only applies to federal requirements and not to state requirements. Also, the 1135 waiver authority can only be invoked when: (A) two separate federal declarations of an emergency/disaster are made (see below) and (B) the HHS Secretary officially invokes the waiver authority.
    • Presidential Declaration
      • National Emergencies Act; or
      • Stafford Act
  • HHS Secretarial Declaration of a Public Health Emergency Under Section 319 of the Public Health Service (PHS) Act.
