DOJ Launches 10 Regional Elder Justice Task Forces

The U.S. Department of Justice (DOJ) and the U.S. Department of Health and Human Services Administration on Aging and Office of Inspector General (OIG), along with the National Association of Medicaid Fraud Control Units (NAMFCU) and National Adult Protective Services Association (NAPSA), and the state LTC Ombudsman offices announced the launch of 10 regional Elder Justice Task Forces to include:

  • Northern District of California
  • Northern District of Georgia
  • District of Kansas
  • Western District of Kentucky
  • Northern District of Idaho
  • District of Maryland
  • Southern District of Ohio
  • Eastern District of Pennsylvania
  • Middle District of Tennessee
  • Western District of Washington

These task forces will “[coordinate] and [enhance] efforts [among federal, state and local prosecutors, law enforcement, and various other agencies] to identify and bring to justice nursing homes that provide grossly substandard care to their residents.” AHCA/NCAL has responded to the press expressing concern with the overstatements in both the press release and the statement from DOJ. AHCA/NCAL is working to understand better how the recent DOJ announcement evolved. They have learned that the Task Force work will likely revolve around potential False Claims Act (FCA) litigation, with alleged fraud claims against Medicare and Medicaid providers.
